2. ELIGIBILITY
You must be at least 18 years old or have permission from a parent or legal guardian to use our Services.
By using this website, you confirm that all information provided is accurate and complete.
3. OUR PRODUCTS
Ever Portrait specializes in custom hand-painted oil portraits created from customer-submitted photographs.
Because each artwork is handmade:
· Every painting is unique.
· Minor artistic variations may occur.
· Colors may vary slightly due to screen settings.
· Brushwork and texture naturally differ from digital previews.
These variations are not considered defects.
4. PHOTO SUBMISSION REQUIREMENTS
Customers are responsible for providing photographs suitable for painting.
Submitted photos should:
· Be clear and high resolution.
· Accurately represent the subject.
· Be owned by the customer or used with permission.
Ever Portrait is not responsible for quality issues caused by low-resolution or unclear reference photos.
5. ORDER PROCESS
After an order is placed:
Step 1
Customer submits photos and special instructions.
Step 2
Our artists begin preparing the portrait.
Step 3
A first preview is typically provided within 24 hours after all reference materials have been received.
Step 4
Customers may request reasonable revisions during the preview stage.
Step 5
Once the final artwork is approved, production is completed and prepared for shipment.
6. REVISIONS
We want every portrait to accurately reflect your memories.
Therefore:
· Revision requests are accepted during the preview process.
· Multiple reasonable revisions are included.
· Revision requests must be submitted before final approval.
After final approval and shipment, additional changes cannot be made.
7. CUSTOM PRODUCT POLICY
All Ever Portrait artworks are custom-made and created specifically for each customer.
Because of the personalized nature of our products:
· Approved custom artworks cannot be canceled after production has begun.
· Approved and delivered custom artworks are generally non-returnable.
Exceptions are outlined in our Refund Policy.
8. PRICING AND PAYMENT
All prices displayed on the website are shown in U.S. Dollars (USD) unless otherwise stated.
Payment must be completed before production begins.
We reserve the right to:
· Adjust pricing
· Correct pricing errors
· Cancel fraudulent orders
at our sole discretion.
9. SHIPPING AND DELIVERY
Estimated production time:
7–10 business days
Estimated shipping time:
7–10 business days
Delivery times are estimates only and are not guaranteed.
We are not responsible for delays caused by:
· Shipping carriers
· Customs clearance
· Weather conditions
· Natural disasters
· Events outside our control
Risk of loss transfers to the customer upon delivery to the shipping carrier.
10. DAMAGED OR LOST SHIPMENTS
If an artwork arrives damaged:
· Contact us within 7 days of delivery.
· Provide photos of the packaging and damage.
If approved, we may:
· Replace the artwork
· Provide a partial refund
· Provide a full refund
at our discretion.
11. INTELLECTUAL PROPERTY
All website content including:
· Text
· Graphics
· Logos
· Product photographs
· Designs
· Marketing materials
is owned by Ever Portrait and protected by applicable intellectual property laws.
No content may be copied, reproduced, or distributed without written permission.
12. CUSTOMER CONTENT
By submitting photographs to Ever Portrait, you confirm that:
· You own the images or have permission to use them.
· The images do not violate any third-party rights.
You grant Ever Portrait permission to use submitted photos solely for the purpose of creating your commissioned artwork.
We will not sell your photos to third parties.
13. ARTWORK DISPLAY RIGHTS
Unless specifically requested otherwise, Ever Portrait may display completed artworks on:
· Our website
· Social media platforms
· Marketing materials
· Portfolio galleries
for promotional purposes.
Customers may request privacy by contacting us before production begins.

14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Ever Portrait shall not be liable for:
· Indirect damages
· Consequential damages
· Lost profits

· Delays beyond our control
Our total liability shall not exceed the amount paid for the order.
15. GOVERNING LAW
These Terms shall be governed by the laws of the State of Wyoming, United States.
Any disputes arising from these Terms shall be resolved in the courts located within Wyoming.
16. CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms at any time.
Updated versions will be posted on this page with a revised effective date.
Continued use of the website constitutes acceptance of the updated Terms.
