This Privacy Policy describes how everportrait.com (the “Site” or “We”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site. The Site is operated by Everportrait Inc (“Ever Portrait,” “We,” “Us,” or “Our”). The Site is not designed with the primary purpose of collecting personal information; any information collected is incidental to providing our products and services to you.

1.2 Order Information

·      Examples of Personal Information Collected: Name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.

·      Purpose of Collection: To provide products or services to you to fulfill our contract, process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and, when in line with the preferences you have shared with Us, provide you with information or advertising relating to our products or services.

·      Source of Collection: Collected from you.

·      Disclosure for a Business Purpose: Shared with our processor Shopify and payment processing partners.

SSL Encryption: All payment information, including credit card numbers, is collected on secure pages protected by SSL (Secure Socket Layer) encryption technology. This ensures that your sensitive financial data is transmitted securely and remains confidential during the checkout process.

1.3 Customer Support Information

·      Examples of Personal Information Collected: Name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.

·      Purpose of Collection: To provide customer support.

2. Sharing Personal Information

We share your Personal Information with service providers to help Us provide our services and fulfill our contracts with you, as described above. For example:

We Do Not Sell Personal Information: Everportrait Inc does not sell, rent, or trade your contact information or any other Personal Information to third parties for their marketing or commercial purposes. We also do not sell Personal Information as defined under the California Consumer Privacy Act (CCPA).


3. Behavioural Advertising

As described above, We use your Personal Information to provide you with targeted advertisements or marketing communications We believe may be of interest to you. For example:

·      We share information about your use of the Site, your purchases, and your interaction with our ads on other websites with our advertising partners. We collect and share some of this information directly with our advertising partners and, in some cases, through the use of cookies or other similar technologies (which you may consent to, depending on your location).

Use of Images in Advertising: We do not use your personal images, portrait photos, or photographs for advertising or marketing purposes without your explicit prior consent. Images you submit to Ever Portrait are used solely for the purpose of creating your ordered products and will not appear in any marketing materials, advertisements, or promotional content unless you have given Us express written permission.

4. Using Personal Information

We use your Personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, keeping you up to date on new products, services, and offers, and providing customer support.

Free Gifts and Incentive Programs: From time to time, We may offer free gifts, promotional items, or other incentives (collectively, “Incentives”). Any Incentives offered by Ever Portrait are only provided under the following circumstances:

(a)     When you make a qualifying purchase of our products;

·       

(b)    As part of a marketing campaign or promotion where the material terms are clearly disclosed to you; or

(c)     Where the primary purpose is not the collection of your Personal Information.

We do not offer Incentives solely for the purpose of inducing you to provide Personal Information. If any Incentive involves the collection of Personal Information, We will provide you with clear notice of the material terms at the time of offer, and you will have the right to opt in before participating. You may withdraw from any Incentive program at any time by contacting Us.


5. Lawful Basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), We process your Personal Information under lawful bases including your consent, the performance of a contract, compliance with legal obligations, and our legitimate interests. For residents of the United States, this Privacy Policy is governed by applicable U.S. federal and state laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).


6. Retention

When you place an order through the Site, We will retain your Personal Information for our records unless and until you ask Us to erase this information. For more information on your right of erasure, please see the “Your Rights” section below.


7. Automatic Decision-Making

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor, Shopify, uses limited automated decision-making to prevent fraud, which does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:

·      Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.

·      Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.


8. Your Rights

8.1 CCPA Rights (California Residents)

If you are a resident of California, you have the following rights under the California Consumer Privacy Act (CCPA):

Right to Know: You have the right to request that We disclose what Personal Information We collect, use, disclose, and sell. Specifically, you may request: (a) the categories of Personal Information We have collected about you; (b) the categories of sources from which the Personal Information is collected; (c) the business or commercial purpose for collecting or selling Personal Information; (d) the categories of third parties with whom We share Personal Information; and (e) the specific pieces of Personal Information We have collected about you.

Right to Delete: You have the right to request that We delete any Personal Information We have collected from you, subject to certain exceptions (such as completing a transaction for which the Personal Information was collected, detecting security incidents, complying with legal obligations, or other internal uses that are compatible with the context in which you provided the information).

Right to Opt-Out of Sale: Under the CCPA, you have the right to direct businesses not to sell your Personal Information. As stated in Section 2 of this Privacy Policy, Everportrait Inc does not sell Personal Information. Nevertheless, if you wish to formally exercise your right to opt-out, you may contact Us using the information in Section 12.

Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means We will not deny you goods or services, charge you different prices or rates, provide a different level or quality of goods or services, or suggest that you may receive a different price or rate or a different level or quality of goods or services because you exercised your CCPA rights.

Authorized Agent: You may designate an authorized agent to submit a CCPA request on your behalf. To do so, you must provide the authorized agent with written permission to make the request, and We may require that you verify your identity directly with Us before processing the request.

How to Exercise Your CCPA Rights: To exercise any of your rights under the CCPA, please contact Us at support@everportrait.com. We will respond to verifiable consumer requests within 45 days as required by law. Before processing your request, We will take reasonable steps to verify your identity to protect your information. The verification process may require you to provide information that matches what We already have on file for you.

8.2 GDPR Rights (EEA Residents)

If you are a resident of the EEA, you have the right to access the Personal Information We hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then transferred outside of Europe for storage and further processing, including to Canada and the United States.
